Pursuant to section 167 of the Land Transport Act 1998, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations

1 Title

These regulations are the Land Transport (Offences and Penalties) Amendment Regulations 2011.

2 Commencement

These regulations come into force on 1 August 2011.

3 Principal regulations amended

These regulations amend the Land Transport (Offences and Penalties) Regulations 1999.

4 Infringement offences

Regulation 4(7)(a) is amended by inserting “in” after “specified”.

5 Demerit points

Regulation 6(3) is amended by omitting “in respect an offence” and substituting “in respect of an offence”.

6 Offences parking wardens may enforce

Regulation 10 is amended by omitting “For the purposes of sections 128E(1)(b)(iii) and” and substituting “For the purpose of section”.

7 Schedule 1 amended

Schedule 1 is amended in the manner set out in Schedule 1 of these regulations.

8 Schedule 2 amended

Part 1 of Schedule 2 is amended in the manner set out in Schedule 2 of these regulations.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 1 August 2011, amend the Land Transport (Offences and Penalties) Regulations 1999.

The amendments specify new penalties with respect to Land Transport Rule: Operator Licensing 2007. That rule contains new requirements for communications and in-vehicle security systems for improving the safety of taxi drivers and passengers.

The amendments also correct typographical errors in the regulations and remove a reference in regulation 10 to a draft provision that was not enacted.
