Regulations

1 Title

These regulations are the Films, Videos, and Publications Classification (Fees) Amendment Regulations 2022.

2 Commencement

These regulations come into force on 6 May 2022.

3 Principal regulations

These regulations amend the Films, Videos, and Publications Classification (Fees) Regulations 1994.

4 Regulation 2 amended (Interpretation)

In regulation 2(1), insert in its appropriate alphabetical order:

online publication has the meaning given in section 119A of the Act

5 Regulation 8 amended (Fee for publications submitted as a group)

In regulation 8(1)(a), after “section 12”, insert “or section 14A”.

6 Regulation 12 amended (Payment of fees)

In regulation 12(1), after “section 12”, insert “or section 14A” in each place.

7 Schedule amended

In the Schedule, Part 1, item 1, after “the Act”, insert “or submission of online publication under section 14A of the Act”.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on 6 May 2022, amend the Films, Videos, and Publications Classification (Fees) Regulations 1994 (the principal regulations).

These regulations amend the principal regulations to prescribe the fees to be paid to the Chief Censor under section 14A of the Films, Videos, and Publications Classification Act 1993. An online content host must pay the fees for a submission under section 13(1)(ba) of that Act (following the issue of a take-down notice relating to an online publication).

Regulatory impact statement

The Department of Internal Affairs produced an Annex to the regulatory impact statement “Countering violent extremism online—changes to censorship legislation to better protect New Zealanders from online harm” on 23 March 2022 to help inform the decisions taken by the Government relating to the contents of this instrument.
