This order is made under section 13(2) of the Commodity Levies Act 1990 (as applied by section 305 of the Fisheries Act 1996)—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister for Oceans and Fisheries given after complying with the requirements of section 5 of the Commodity Levies Act 1990 (except section 5(1)(b)).
Order
1 Title
This order is the Commodity Levies (Paua) Amendment Order 2022.
2 Commencement
This order comes into force on 1 February 2023.
Order: confirmed, on 23 December 2023, by section 8(b) of the Secondary Legislation Confirmation Act 2023 (2023 No 67).
3 Principal order
This order amends the Commodity Levies (Paua) Order 2013.
4 Clause 2A replaced (Extension and revocation)
Replace clause 2A with:
2A Extension and revocation
This order is extended until the close of 24 February 2029 and, unless further extended or sooner revoked, is revoked at the close of that date.
5 Clause 3 amended (Interpretation)
In clause 3, definition of levy year, paragraph (b), replace “1 October 2023 and ending on 24 February 2024”
with “1 October 2028 and ending on 24 February 2029”
.
6 Clause 20 amended (Remuneration of persons conducting compliance audit)
In clause 20, replace “Minister of Fisheries”
with “Minister for Oceans and Fisheries”

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order comes into force on 1 February 2023. It amends the Commodity Levies (Paua) Order 2013 (the principal order). This order—
extends the period for which the principal order is in force by 5 years; and
amends the definition of levy year in the principal order to reflect that extension; and
changes a reference to the Minister of Fisheries in the principal order to refer to the Minister for Oceans and Fisheries.
This order must be confirmed by an Act before the close of 31 December 2023. If it is not confirmed, it will be revoked on the close of that date. See subpart 3 of Part 5 of the Legislation Act 2019.

1 General
This is a consolidation of the Commodity Levies (Paua) Amendment Order 2022 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
