Order

1 Title

This order is the State-Owned Enterprises (KiwiRail Holdings Limited) Order 2012.

2 Commencement

This order comes into force on 31 December 2012.

3 Schedules 1 and 2 of State-Owned Enterprises Act 1986 amended

In Schedules 1 and 2 of the State-Owned Enterprises Act 1986, insert in its appropriate alphabetical order “KiwiRail Holdings Limited”.

4 Schedule 1 of Ombudsmen Act 1975 amended

In Schedule 1 of the Ombudsmen Act 1975, Part 2, insert in its appropriate alphabetical order “KiwiRail Holdings Limited”.

5 Schedule 36 of Income Tax Act 2007 amended

In Schedule 36 of the Income Tax Act 2007, Part A, insert in its appropriate alphabetical order “KiwiRail Holdings Limited”.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 31 December 2012, provides for KiwiRail Holdings Limited, a company formed and registered in accordance with section 4 of the New Zealand Railways Corporation Restructuring Act 1990, to become a State enterprise under the State-Owned Enterprises Act 1986.

The order also adds KiwiRail Holdings Limited to Schedule 1 of the Ombudsmen Act 1975, making KiwiRail Holdings Limited subject to that Act and the Official Information Act 1982.

Finally, the order adds KiwiRail Holdings Limited to Schedule 36, Part A, of the Income Tax Act 2007, making KiwiRail Holdings Limited a State enterprise for the purposes of that Act.
