These regulations are made under section 269 of the Land Transport Act 1998 on the advice and with the consent of the Executive Council.

Regulations
1 Title
These regulations are the Land Transport (Motor Vehicle Registration and Licensing) Amendment Regulations 2023.
2 Commencement
These regulations come into force on 1 October 2023.
3 Principal regulations
These regulations amend the Land Transport (Motor Vehicle Registration and Licensing) Regulations 2011.
4 Regulation 3 amended (Interpretation)
In regulation 3, insert in their appropriate alphabetical order:
agent means a person who—
(a)
provides specified services on behalf of the Registrar; and
(b)
is recognised as an agent by the Registrar because they hold a delegation from the Registrar to deliver the specified services
Direct Connect means a service offered by the Registrar to a transport operator that authorises the transport operator to complete specified motor vehicle registration and licensing activities—
(a)
under an applicable delegation from the Registrar to the transport operator; and
(b)
in respect of motor vehicles owned or leased by the transport operator
motor vehicle industry agent means a person who—
(a)
holds a delegation from the Registrar to deliver services for which the Registrar has responsibility, including, without limit, motor vehicle registration and licensing activities; and
(b)
provides those services on behalf of the Registrar to the person’s customers
online service means a service provided—
(a)
by, or on behalf of, the Agency or the Registrar; and
(b)
for the purpose of enabling persons to make requests for information from the register of motor vehicles
register of motor vehicles means the register continued and maintained by the Registrar under section 234 of the Act
Registrar has the meaning given in section 233(1) of the Act
5 Regulation 19 amended (Exemptions from certain requirements)
In regulation 19(2), after “used”

6 Regulation 48 amended (Notice by person who acquires motor vehicle)
Replace regulation 48(3) with:

The notification required by section 247(1)(b) or (2) of the Act must be accompanied by the certificate of registration of the motor vehicle, if production of it is required by the Registrar.
7 Regulation 50 amended (Change from joint to sole registered person)
In regulation 50(3), delete “payment of the prescribed fee and”

8 Regulation 53 amended (Application under section 241(3)(a) and (4) of Act)

9 Regulation 62 revoked (Reflectorised registration plates)
Revoke regulation 62.
10 Regulation 63 amended (Registration and licensing fees)
(1)
After regulation 63(1), insert:

The fees specified in Part 1A of Schedule 5 are in addition to the fees specified in Parts 1 and 5 of Schedule 5.
(2)
In regulation 63(2), replace “Parts 2, 2A, 3, and 4”
with “Parts 2 and 4”

11 Regulation 64 amended (Fees for registration plates)
(1)
Replace regulation 64(1) with:

The fees payable for the production and issue of a registration plate (including plates for use on official motor vehicles allocated to New Zealand Government Ministers of the Crown) are specified in Part 5 of Schedule 5.
(2)
Replace regulation 64(2)(b) with:

in the case of personalised plates, the fee must accompany the request for the production and issue of the plates:

17 New regulations 68A and 68B inserted
After regulation 68, insert:
68A Fee for electronic connection
(1)
The fee payable for creating, providing, or modifying an electronic connection to enable a person to obtain or access information held by the Agency or the Registrar through an online service is the actual and reasonable costs incurred by the Agency or the Registrar in creating, providing, or modifying the electronic connection.
(2)
Without limiting subclause (1), the actual and reasonable costs referred to in subclause (1) may include the cost of services carried out by third parties on behalf of the Agency or the Registrar in relation to the creation, provision, or modification of the electronic connection.
(3)
For the purposes of this regulation, the electronic connection must be—
(a)
between the electronic systems of—
(i)
the Agency or the Registrar; and
(ii)
a person who wishes to obtain or access, through an online service, information held by the Agency or the Registrar; and
(b)
necessary to enable the person to obtain or access the information through an online service.
68B Miscellaneous fees
The fees payable for the following are specified in Part 7 of Schedule 5:
(a)
application to relicense a fleet of motor vehicles:
(b)
application by an overseas visitor to import a motor vehicle on a temporary basis:
(c)
issue of a motor vehicle licence invoice for outstanding licensing fees:
(d)
set-up of direct debit facilities for Direct Connect customers and motor vehicle industry agents.
18 Regulation 70 amended (Apportionment of liability for licence fees and accident insurance levies)
In regulation 70(1), delete “, the additional annual licence fee,”
in each place.
19 Regulation 71 amended (Abatement of licence fees and accident insurance levies)

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 October 2023, amend the Land Transport (Motor Vehicle Registration and Licensing) Regulations 2011 (the principal regulations). These regulations amend Schedule 5 of the principal regulations and make consequential amendments to the principal regulations.
Schedule 5 is amended to prescribe fees for—
registration (Parts 1 and 1A):
licences (Parts 2 and 4):
certain RUC (road user charges) vehicles (Part 3):
registration plates (Part 5):
information from the register of motor vehicles (Part 6):
miscellaneous matters (Part 7).
The amendments to Schedule 5 increase, introduce, decrease, and revoke certain existing fees.
