Transport (Change of Ownership) Regulations 1995: revoked, on 1 May 2011, by regulation 97(d) of the Land Transport (Motor Vehicle Registration and Licensing) Regulations 2011 (SR 2011/79).

These regulations are administered by the Ministry of Transport.

Pursuant to sections 20(2) and 48 of the Transport (Vehicle and Driver Registration and Licensing) Act 1986, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following regulations.

1 Title and commencement

(1) These regulations may be cited as the Transport (Change of Ownership) Regulations 1995.

(2) These regulations shall come into force on 30 October 1995.

2 Interpretation

In these regulations, unless the context otherwise requires,—

the Act means the Transport (Vehicle and Driver Registration and Licensing) Act 1986

register means a register kept under section 18 of the Act

registered trader means a motor vehicle trader registered under the Motor Vehicle Sales Act 2003.

3 Obligations of person who acquires ownership of motor vehicle

Every person who acquires ownership of a registered motor vehicle shall, within 7 days after the date of the acquisition of the motor vehicle, supply to the Registrar—
- (a) the appropriate prescribed fee; and
- (b) a notice of change of ownership containing the particulars required by section 22 of this Act and completed to the satisfaction of the Registrar; and
- (c) the certificate of registration of the motor vehicle, unless production of it has been waived by the Registrar; and
- (d) evidence of the identity of the person to be registered as the new owner of the motor vehicle showing, to the satisfaction of the Registrar, that the person is qualified under section 22(3) of the Act to be the registered owner; and
- (e) such other information or documents as the Registrar may require under section 22(2) of the Act.

4 Registration of change of ownership

On payment of the prescribed fee and receipt of the documents and evidence referred to in regulation 3, the Registrar shall—
- (a) endorse on the appropriate register the name and address of the new registered owner of the motor vehicle; and
- (b) if so requested, immediately issue an acknowledgment of change in the registered ownership of the motor vehicle; and
- (c) issue a new certificate of registration endorsed with the particulars of the change in registered ownership and forward that new certificate to the new registered owner.

5 Correction of register

The Registrar, on application by any party to the sale or disposition of a registered motor vehicle or on the Registrar's own motion, may correct any entry in the appropriate register relating to the sale or other disposition of the vehicle if he or she is satisfied that the action is necessary to correct an error.

6 Forms

The Registrar may provide forms for the purposes of section 20(1) of the Act.

7 Fees

(1) Where, under regulation 4, the Registrar endorses on the appropriate register particulars of the change in the ownership of a motor vehicle, the fee payable under section 25 of the Act for the endorsement shall be $9.20.

(2) The fee prescribed by subclause (1) shall be payable by the person who acquires ownership of the registered motor vehicle.

(3) The Registrar may discount the fee prescribed by subclause (1) where the person liable to pay the fee is a registered trader.

(4) The fee prescribed by subclause (1) is inclusive of any goods and services tax payable under the Goods and Services Tax Act 1985.

1 General

2 Status of reprints

Under section 16D of the Acts and Regulations Publication Act 1989, reprints are presumed to correctly state, as at the date of the reprint, the law enacted by the principal enactment and by the amendments to that enactment. This presumption applies even though editorial changes authorised by section 17C of the Acts and Regulations Publication Act 1989 have been made in the reprint.

3 How reprints are prepared

A number of editorial conventions are followed in the preparation of reprints. For example, the enacting words are not included in Acts, and provisions that are repealed or revoked are omitted. 4 Changes made under section 17C of the Acts and Regulations Publication Act 1989

Section 17C of the Acts and Regulations Publication Act 1989 authorises the making of editorial changes in a reprint as set out in sections 17D and 17E of that Act so that, to the extent permitted, the format and style of the reprinted enactment is consistent with current legislative drafting practice. Changes that would alter the effect of the legislation are not permitted.

A new format of legislation was introduced on 1 January 2000. Changes to legislative drafting style have also been made since 1997, and are ongoing. To the extent permitted by section 17C of the Acts and Regulations Publication Act 1989, all legislation reprinted after 1 January 2000 is in the new format for legislation and reflects current drafting practice at the time of the reprint.

In outline, the editorial changes made in reprints under the authority of section 17C of the Acts and Regulations Publication Act 1989 are set out below, and they have been applied, where relevant, in the preparation of this reprint:

- •typeface and type size (Times Roman, generally in 11.5 point)
