These regulations are made under section 167 of the Climate Change Response Act 2002 on the advice and with the consent of the Executive Council.

Regulations
1 Title
These regulations are the Climate Change (Emissions Rulings: Fees and Charges) Amendment Regulations 2022.
2 Commencement
These regulations come into force on 12 January 2023.
3 Principal regulations
These regulations amend the Climate Change (Emissions Rulings: Fees and Charges) Regulations 2010.
4 Regulation 4 replaced (Fee and charge on and after 1 October 2010)
Replace regulation 4 with:
4 Fee and charge for application
(1)
The fee payable for an application is $495.00.
(2)
The charge payable for the application is $165.00 for each hour or part of an hour spent in processing the application after the first 4 hours.
5 Regulation 5 amended (Goods and services tax)
In regulation 5, replace “inclusive”
with “exclusive”
.
6 Regulation 11 revoked (Fee and charge before 1 October 2010)
Revoke regulation 11.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 12 January 2023, amend the Climate Change (Emissions Rulings: Fees and Charges) Regulations 2010. The amendments—
increase the fee and charge payable for an application for an emissions ruling under section 107 of the Climate Change Response Act 2002:
provide that the fee and charge are exclusive of goods and services tax:
revoke a spent regulation that relates to the fee and charge payable for an application received before 1 October 2010.
