These regulations are made under section 16B(1) of the Family Court Act 1980 and section 187 of the Family Proceedings Act 1980 on the advice and with the consent of the Executive Council.
Regulations
1 Title
These regulations are the Family Court (Fees) Amendment Regulations 2025.
2 Commencement
These regulations come into force on 17 October 2025.
3 Principal regulations
These regulations amend the regulations that were previously called the Family Courts Fees Regulations 2009.
4 Title of principal regulations changed
In regulation 1, replace “Family Courts Fees”
with “Family Court (Fees)”
.
5 Enacting statement amended
In the enacting statement, replace “Courts”
with “Court”
.
6 Schedule 1 amended
(1)
In Schedule 1, item 4, replace “an order dissolving a marriage or civil union”
with “a dissolution order: irreconcilable breakdown”
.
(2)
In Schedule 1, after item 4, insert:

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations, which come into force on 17 October 2025, amend the regulations that were previously called the Family Courts Fees Regulations 2009 (the principal regulations) to—
update the Title of the principal regulations to reflect the renaming of the Family Court by section 249 of the District Court Act 2016; and
adjust the description of the existing fee for an application under section 37 of the Family Proceedings Act 1980 (the Act) for an order dissolving a marriage or civil union on the ground of irreconcilable breakdown. This aligns the principal regulations with changes made to the Act by the Family Proceedings (Dissolution of Marriage or Civil Union for Family Violence) Amendment Act 2024 (the amendment Act); and
prescribe the fee for an application under section 39A of the Act (as inserted by the amendment Act) for an order dissolving a marriage or a civil union on the ground that the applicant is a protected person under a protection order.
