These regulations are made under section 164 of the Climate Change Response Act 2002—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Climate Change made after complying with sections 3A and 3B of that Act.

Regulations
1 Title
These regulations are the Climate Change (Unique Emissions Factors) Amendment Regulations 2025.
2 Commencement
(1)
These regulations come into force on 1 January 2026.
(2)
However, regulation 6 comes into force on 31 December 2025.
3 Principal regulations
These regulations amend the Climate Change (Unique Emissions Factors) Regulations 2009.
4 Regulation 23C amended (Requirements relating to application for unique emissions factor approval in relation to LFG collection and destruction system)
(1)
In regulation 23C, after “facility”
, insert “or other site where LFG is destroyed”
in each place.
(2)
In regulation 23C(1)(g), formula, replace “0.91”
with “1.023”
.
(3)
In regulation 23C(2)(b)(ii)(A), delete “from the second column”
.
(4)
In regulation 23C(2)(e), item relating to equivalent methane generation potential, replace “third or fourth column”
with “fifth or sixth column”
.
(5)
In regulation 23C(2)(e), item relating to decay rate constant, replace “fifth column”
with “seventh column”
.
5 Schedule 3 replaced
Replace Schedule 3 with the Schedule 3 set out in Schedule 1 of these regulations.
6 Consequential amendments to Climate Change (Unique Emissions Factors) Amendment Regulations 2024
Amend the Climate Change (Unique Emissions Factors) Amendment Regulations 2024 as set out in Schedule 2 of these regulations.

In regulation 2(2), replace “Regulations 6, 7, and 8 come”
with “Regulation 7 comes”

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations, which mostly come into force on 1 January 2026, amend the Climate Change (Unique Emissions Factors) Regulations 2009 (the principal regulations).
These regulations—
amend requirements set out in regulation 23C of the principal regulations that apply to a waste participant who wishes to calculate a unique emissions factor that relates to the use of an LFG collection and destruction system at a disposal facility; and
replace Schedule 3 of the principal regulations with new Schedule 3, which relates to first-order decay parameters that are used in the calculations set out in regulation 23C of the principal regulations; and
make consequential amendments, which come into force on 31 December 2025, to the Climate Change (Unique Emissions Factors) Amendment Regulations 2024.
