Pursuant to section 80 of the Criminal Investigations (Bodily Samples) Act 1995, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
Regulations
1 Title
These regulations are the Criminal Investigations (Bodily Samples) Amendment Regulations (No 2) 2010.
2 Commencement
These regulations come into force on 6 September 2010.
3 Principal regulations amended
These regulations amend the Criminal Investigations (Bodily Samples) Regulations 2004.
4 Schedule amended
Form 5B of the Schedule (as inserted by regulation 4(a) of the Criminal Investigations (Bodily Samples) Amendment Regulations 2010) is amended—
(a) by omitting the heading
“Can I have someone with me when I give my sample?”
and the rest of that item (including the reference to section 50 of the Criminal Investigations (Bodily Samples) Act 1995):
(b) by omitting the heading
“Notification of right to have person present during taking of bodily sample”
and the rest of that item (including the requested person details).

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 6 September 2010, amend the Criminal Investigations (Bodily Samples) Regulations 2004.
The regulations correct Form 5B in the Schedule of the Criminal Investigations (Bodily Samples) Regulations 2004 by omitting items that were inadvertently included about persons entitled to be present when a bodily sample is taken. Form 5B is a notice to give a bodily sample under Part 2B of the Criminal Investigations (Bodily Samples) Act 1995 and applies to persons of or over 17 years of age.
