Fisheries (Demerit Points and Civil Penalties) Amendment Regulations 2004

Note

These regulations are administered in the Ministry of Fisheries.

Pursuant to section 296ZI of the Fisheries Act 1996, Her Excellency the Administrator of the Government, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Amendments to Schedule 1 of principal regulations

1 Title

(1) These regulations are the Fisheries (Demerit Points and Civil Penalties) Amendment Regulations 2004.

(2) In these regulations, the Fisheries (Demerit Points and Civil Penalties) Regulations 2001¹ are called “the principal regulations”.

2 Commencement

These regulations come into force on the 28th day after the date of their notification in the Gazette.

3 Schedule 1 amended

(1) Schedule 1 of the principal regulations is amended by adding to item 11 the item set out in Part 1 of the Schedule.

(2) Schedule 1 of the principal regulations is amended by adding to item 13 the item set out in Part 2 of the Schedule.

(3) Schedule 1 of the principal regulations is amended by adding the item set out in Part 3 of the Schedule.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend the Fisheries (Demerit Points and Civil Penalties) Regulations 2001 by—

•adding new items to items 11 and 13 of Schedule 1; and
•adding a new item 25 to Schedule 1.

The new items for items 11 and 13 of Schedule 1 introduce demerit points in relation to settlement quota on registers (item 11) and transfers of settlement quota (item 13).

New item 25 deals with demerit points in relation to approved service delivery organisation debt recovery.
