Fisheries (Foreign Fishing Vessel) Amendment Regulations 2002
Note
These regulations are administered in the Ministry of Fisheries.
Pursuant to section 299 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
-
(1) These regulations are the Fisheries (Foreign Fishing Vessel) Amendment Regulations 2002.
(2) In these regulations, the Fisheries (Foreign Fishing Vessel) Regulations 20011 are called
“the principal regulations”
.
2 Commencement
These regulations come into force on 11 July 2002.
3 Interpretation
Regulation 3(1) of the principal regulations is amended by revoking the definition of inspection port, and substituting the following definition:
“inspection port, in relation to any particular foreign fishing vessel, means any New Zealand port that the Minister has, by notification to the operator, licence holder, or master of the vessel, or the National Fisheries Representative of the vessel, designated as an inspection port for the purposes of these regulations.”
4 Communications must be given through National Fisheries Representative
Regulation 5 of the principal regulations is amended by omitting the words
“licensee, owner”
, and substituting the words“licence holder, operator”
.
5 Issue of licence
Regulation 7 of the principal regulations is amended by omitting the word
“owner”
, and substituting the word“operator”
.
6 Endorsement of variation of licence
-
(1) Regulation 8(1) of the principal regulations is amended by—
(a) omitting the word
“licensee”
, and substituting the words“licence holder”
; and
(b) omitting the word
“owner”
, and substituting the word“operator”
.
(2) Regulation 8(2) of the principal regulations is amended by omitting the word
“licensee”
, and substituting the words“licence holder”
.
7 Duplicate licence
Regulation 10 of the principal regulations is amended by omitting the word
“licensee”
, and substituting the words“licence holder”
.
8 Facilities for observers and fishery officers
Regulation 33(3) of the principal regulations is amended by omitting the word
“licensee”
, and substituting the words“licence holder”
.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 11 July 2002, amend the Fisheries (Foreign Fishing Vessel) Regulations 2001 (“the principal regulations”
). The amendments replace references to “licensee”
and “owner”
with references to “licence holder”
and “operator”
in the body of the principal regulations, and add “operator”
to the persons listed in clause 11 of form 1 in Schedule 1 of the principal regulations.
