Hazardous Substances (Fireworks) Amendment Regulations 2003

Note

These regulations are administered in the Ministry for the Environment.

Pursuant to sections 75(1)(a) and 140(1)(r) of the Hazardous Substances and New Organisms Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council (given on the recommendation of the Minister for the Environment made in compliance with section 141(1) of that Act), makes the following regulations.

  • These regulations come into force on the 28th day after the date of their notification in the Gazette.

3 Application

  • Regulation 4(2) of the principal regulations is amended by omitting the words “these regulations”, and substituting the words “regulations 6, 7, and 8”.

4 Test certificate for fireworks

  • Regulation 11(1)(g) of the principal regulations is amended by omitting the words “create a hazard by discharging hot or burning material”, and substituting the words “, on discharge, result in hot or burning material falling to the ground in a manner that creates a hazard”.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend the Hazardous Substances (Fireworks) Regulations 2001—

  • •by requiring the fireworks listed in regulation 4(2) to comply with the regulations other than regulations 6, 7, and 8. Previously, none of the principal regulations applied to these categories of fireworks:

  • •by clarifying the test certificate requirement in regulation 11(1)(g).
