Lotto Amendment Rules 2010: revoked, on 29 September 2025, pursuant to rule 67 of the Lotto Rules 2025 (SL 2025/174).

These rules are administered by the New Zealand Lotteries Commission.
Pursuant to section 243 of the Gambling Act 2003, the Minister of Internal Affairs approves the following rules, which were made by the New Zealand Lotteries Commission on 25 August 2010.

Rules
1 Title
These rules are the Lotto Amendment Rules 2010.
2 Commencement
These rules come into force on 3 October 2010.
3 Principal rules amended
These rules amend the Lotto Rules 2000.
4 Cost of selection
Rule 8(b) is amended by omitting “50”
and substituting “60”
.
5 New rule 31A inserted
The following rule is inserted after rule 31:
31A Commission may determine maximum allocation for division one
(1)
The Commission may determine the maximum amount that may be allocated to division one out of the prize pool for a game of standard lotto.
(2)
If, in a game of standard lotto, the allocation for division one under rule 31(2)(a) exceeds the maximum allocation determined by the Commission under subclause (1) for that game, the Commission must set aside the amount of the excess from the allocation for division one and pay it into the prize reserve fund.
6 Division of prizes and allocation of prize pool for lotto powerball
Rule 33 is amended by revoking subclause (2) and substituting the following subclause:
(2)
The prize pool for a game of lotto powerball determined in accordance with rule 32(1), less any amount set aside for the prize reserve fund under rule 32(2), must be allocated between the prize divisions as follows:
(a)
division one, 85.74%:
(b)
division two, 2.23%:
(c)
division three, 2.23%:
(d)
division four, 0.6%:
(e)
division five, 4.64%:
(f)
division six, 4.56%.
7 Jackpots for standard lotto and lotto strike
Rule 36(1) is amended by inserting “rule 31A and”
after “restriction in”
.
8 Threshold amount, maximum number of games, and specified lotto powerball date
Rule 36A(1) is amended by revoking paragraph (a) and substituting the following paragraph:
(a)
must determine for division one—
(i)
the maximum amount of the allocation of the prize pool (the threshold amount); and
(ii)
the maximum number of games of lotto powerball for which a jackpot may occur (the maximum number of lotto powerball games):
9 New rule 36B substituted
Rule 36B is revoked and the following rule substituted:
36B Jackpots for lotto powerball
(1)
This rule applies if, as a result of any drawing, there is no division one winning selection for a game of lotto powerball.
(2)
The portion of the available prize pool for the game that was allocated to division one in that drawing must be added, subject to subclause (3), to the division one allocation in the next game (jackpot).
(3)
A jackpot may not occur—
(a)
if, as at the conclusion of the drawing referred to in subclause (1), the jackpot would result in the division one allocation in the next game exceeding the threshold amount for division one; or
(b)
for more than the maximum number of lotto powerball games for division one.
(4)
If a jackpot may not occur because of subclause (3), the division one allocation must be added to the prize pool allocation for the next lowest prize division with 1 or more winning selections.

Explanatory note
This note is not part of the rules, but is intended to indicate their general effect.
These rules, which amend the Lotto Rules 2000 and come into force on 3 October 2010, do the following things:
increase the cost of a powerball selection from 50 cents to 60 cents:
empower the Lotteries Commission to determine a maximum allocation for division one:
adjust the relative allocations for the prize divisions in a game of lotto powerball:
clarify when a jackpot for lotto powerball may occur.

1 General
This is a consolidation of the Lotto Amendment Rules 2010 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
A consolidation is taken to correctly state, as at its stated date, the law enacted or made by the legislation consolidated and by the amendments. This presumption applies unless the contrary is shown.
