These regulations are administered by the Ministry of Transport.
Pursuant to sections 167 and 168 of the Land Transport Act 1998, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
Regulations
1 Title
These regulations are the Land Transport (Driver Licensing and Driver Testing Fees) Amendment Regulations 2010.
2 Commencement
These regulations come into force on 1 July 2010.
3 Principal regulations amended
These regulations amend the Land Transport (Driver Licensing and Driver Testing Fees) Regulations 1999.
4 New regulation 14A
The following regulation is inserted after regulation 14:
14A Rescheduling driver test
(1)
An application to reschedule a driver test (including a test undertaken to obtain an endorsement of a licence) must be accompanied by the fee specified in Part 10A of the Schedule.
(2)
The applicant must make the application on a working day that leaves, after that working day, 2 clear working days, ie, 2 clear periods of 24 hours, before the day on which the test was scheduled to occur.
5 Regulation 15 substituted
Regulation 15 is revoked and the following regulation substituted:
15 Refunds
(1)
Subclause (2) applies to an applicant who—
(a)
makes—
(i)
an application for the issue or renewal of an endorsement of 1 of Type I, O, P, or V; or
(ii)
applications for the issue or renewal of an endorsement of 2 or more of Type I, O, P, or V; and
(b)
pays the fee or fees prescribed for the application or applications; and
(c)
may or may not pay a fit and proper person checking fee; and
(d)
has—
(i)
the application declined; or
(ii)
all the applications declined.
(2)
The applicant is entitled to the following:
(a)
the appropriate refund specified in Part 11 of the Schedule minus the refund processing fee also specified in that Part; and
(b)
if the applicant paid a fit and proper person checking fee, a refund of the proportion of the fee relating to vetting not undertaken.
(3)
Subclause (4) applies to an applicant who—
(a)
makes applications for the issue or renewal of an endorsement of 2 or more of Type I, O, P, or V; and
(b)
pays the fees prescribed for the applications; and
(c)
may or may not pay a fit and proper person checking fee; and
(d)
has 1 or more of the applications granted.
(4)
The applicant is not entitled to any refund for any of the applications that were declined.
(5)
Subclause (6) or (7) applies to an applicant who—
(a)
applies for a driver licence or an endorsement of a licence; and
(b)
pays the fee prescribed for a driver test; and
(c)
gives notice of his or her intention to withdraw from the test.
(6)
If the applicant gives the notice on a working day that leaves, after that working day, 2 clear working days, ie, 2 clear periods of 24 hours, before the day on which the test was scheduled to occur, the applicant is entitled to a refund of the fee paid minus the refund processing fee specified in Part 11 of the Schedule.
(7)
If the applicant gives the notice on a working day that leaves, after that working day, fewer than 2 clear working days, ie, 2 clear periods of 24 hours, before the day on which the test was scheduled to occur, the applicant is entitled to a refund of the fee paid minus the refund processing fee specified in Part 11 of the Schedule only if the time scheduled for the test is reallocated to another applicant.
(8)
If the Agency is satisfied in a particular case that there are special circumstances applicable to the case, it may waive, refund, or rebate a fee prescribed in these regulations or assessed under them.
6 Regulations 15A and 15B revoked
Regulations 15A and 15B are revoked.
7 Schedule amended
The Schedule of the principal regulations is amended by—
(a)
revoking Parts 1 to 4 and substituting Parts 1 to 4 as set out in Schedule 1 of these regulations:
(b)
revoking Part 7 and substituting Part 7 as set out in Schedule 2 of these regulations:
(c)
revoking Parts 9 to 11 and substituting Parts 9 to 11 as set out in Schedule 3 of these regulations.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations change driver licensing and driver testing fees, increasing some, decreasing others, and providing fees for rescheduling a driver test and for processing a cancelled driver test. The regulations come into force on 1 July 2010.

1 General
This is a consolidation of the Land Transport (Driver Licensing and Driver Testing Fees) Amendment Regulations 2010 that incorporates the amendments made to the legislation so that it shows the law as at its stated date.
2 Legal status
