Preamble
At Wellington this 11th day of December 2006
Pursuant to section 303 of the Education Act 1989, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.
Contents
1 Title
These regulations are the Student Allowances Amendment Regulations (No 4) 2006.
2 Commencement
These regulations come into force on 19 January 2007.
3 Principal regulations amended
These regulations amend the Student Allowances Regulations 1998.
4 Application
The amendments made by regulations 5 to 7 apply in respect of allowances payable on and after 19 January 2007, whether granted before, on, or after that date.
5 Assessment of parental income
-
(1) Regulation 4(2)(b) is amended by omitting
“31 December in the year of completion of the course of study”
and substituting“the portion of the course of study to which the allowance relates ends”
.(2) Regulation 4 is amended by adding the following subclause:
“(6) The Chief Executive may extend the time allowed for a student to provide evidence of parental income under subclause (2)(b) if he or she is satisfied that in the particular case there are special circumstances warranting an extension of time.”
6 Suspension of certain allowances for failure of full-time course of study
-
(1) Regulation 30(1) is amended by—
(a) omitting
“, in any year during which the recipient received any payment under it,”
; and
(b) inserting
“in the most recent course of study for which an allowance was paid (the relevant course)”
after“recipient”
.
(2) Regulation 30(2) is amended by omitting
“that year”
in each place where it appears and substituting in each case“the relevant course”
.
7 Schedule 2 amended
Clause 3(3) of Schedule 2 is amended—
(a) by omitting
“to the value calculated as follows:”
and substituting“by 29.41176% of that excess.”
; and
(b) by revoking paragraphs (a) to (c).

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 19 January 2007, amend the Student Allowances Regulations 1998.
These regulations apply in respect of student allowances payable on and after 19 January 2007, and amend aspects of—
•how parental income is assessed:
•how certain allowances are suspended for failed courses:
•how the reduction in the value of the basic grant is calculated if parental income exceeds a certain amount.
