These regulations are made under section 144(1)(a) and (g) of the Births, Deaths, Marriages, and Relationships Registration Act 2021—
(a)
on the advice and with the consent of the Executive Council; and
(b)
on the recommendation of the Minister of Internal Affairs made in accordance with section 144 of that Act.

Regulations
1 Title
These regulations are the Births, Deaths, Marriages, and Relationships Registration (Prescribed Information) Amendment Regulations 2024.
2 Commencement
These regulations come into force on 15 December 2024.
3 Principal regulations
These regulations amend the Births, Deaths, Marriages, and Relationships Registration (Prescribed Information) Regulations 1995.
4 Regulation 2 amended (Interpretation)
In regulation 2(1), insert in its appropriate alphabetical order:
health practitioner has the same meaning as in section 5 of the Health Practitioners Competence Assurance Act 2003
5 Regulation 3 amended (Preliminary notices of birth)
(1)
In regulation 3(1)(e), delete “her”

(2)
In regulation 3(1)(f), delete “her”
in each place.
(3)
In regulation 3(2), replace “his or her”
with “the person’s”
.
6 Regulation 3A amended (Notification of birth for registration)
(1)
In regulation 3A, replace “Maori”
with “Māori”
in each place.

In regulation 3A, insert as subclause (2):

The parent titles that may be included in a notification of birth are as follows:
(a)
mother:

7 Regulation 5B amended (Transfer of charge of body)
In regulation 5B,—
(a)
replace “his or her”
with “the person’s”
in each place:
(b)
replace “he or she”
with “the person”
in each place.
8 Regulation 6 amended (Birth certificates)
(1)
In regulation 6(a)(i), replace “as registered on the initial registration of the birth”
with “as registered in the person’s original birth record”

(2)
Replace regulation 6(a)(ii) with:
(ii)
details of all name changes registered in respect of the person:

Replace regulation 6(a)(vii) with:

in relation to the person’s parents, the following information (as registered in the person’s original birth record):

In regulation 6(b),—

9 New regulation 6AA inserted (Preliminary notices of death)
After regulation 6, insert:
6AA Preliminary notices of death
(1)
A preliminary notice of death provided under section 39 of the Act must contain the following:
(a)
the deceased’s full name:
(b)
the deceased’s date of birth:
(c)
the deceased’s date of death:
(d)
the deceased’s cause of death:
(e)
the full name and contact information of the health practitioner providing the notice.
(2)
In this regulation,—
(a)
contact information, in respect of a health practitioner, means—
(i)
the health practitioner’s contact details; and
(ii)
details of a medical practice, facility, or other workplace where the health practitioner carries on their health profession (where the health practitioner can be contacted about the notice):
(b)
health profession has the same meaning as in section 5 of the Health Practitioners Competence Assurance Act 2003.
10 Regulation 6A amended (Notification of death for registration)
In regulation 6A(b), replace “Maori”
with “Māori”
.
11 Regulation 7 amended (Death certificates)
In regulation 7(1)(b),—
(a)
replace “kainga”
with “kāinga”
in each place:
(b)
replace “ahuatanga”
with “āhuatanga”
in each place:
(c)
replace “Maori”
with “Māori”
in each place.
12 Regulation 8B amended (Information required for application for name change)
Replace regulation 8B(b) with:
(b)
if the person whose name is to be changed is a child, the full name and contact details of the guardian applying for the name change:
(c)
if the person whose name is to be changed is a 16- or 17-year-old who has never been in a marriage, civil union, or de facto relationship, the full name of the guardian who has given written consent.

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations, which come into force on 15 December 2024, amend the Births, Deaths, Marriages, and Relationships Registration (Prescribed Information) Regulations 1995 (the principal regulations).
The amendments to the principal regulations—
make changes related to the commencement of sections 12(3) and 39 of the Births, Deaths, Marriages, and Relationships Registration Act 2021 (the Act); and
make other minor and technical changes.
Regulations 1 and 2 specify the Title and commencement date of these regulations.
Regulation 4 amends regulation 2 to add a definition of health practitioner (a term used in new regulation 6AA and regulation 7 of the principal regulations).
Regulation 6(2) amends regulation 3A to specify the parent titles that may be included in a notification of birth for inclusion on the child’s birth certificate.
Regulation 8(3) amends regulation 6 to make it clear a birth certificate must include the parent title of a person’s parent (as registered in the person’s original birth record).
Regulation 9 inserts new regulation 6AA, which specifies what a preliminary notice of death under section 39 of the Act must contain.
Regulation 12 amends regulation 8B to reflect that, under the Act, a person who is 16 or 17 years old can apply to change their name with the consent of their guardian.
Regulations 5, 6(1), 7, 8, 10, and 11 make other minor changes to the principal regulations to update the language used, improve readability, and add macrons to misspelled words.
