Education (Home-Based Care) Amendment Order 2005: revoked, on 1 June 2016, pursuant to clause 3 of the Education (Home-Based Care) Order Revocation Order 2016 (LI 2016/72).

This order is administered by the Ministry of Education.
Pursuant to section 314(1) of the Education Act 1989, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.
1 Title
(1)
This order is the Education (Home-Based Care) Amendment Order 2005.
(2)
In this order, the Education (Home-Based Care) Order 19921 is called “the principal order”
.
2 Commencement
This order comes into force on 1 July 2005.
3 Standards of care and education
(1)
Clause 5(19) of the Schedule of the principal order is amended by inserting, before the words “custody of”
, the words “the role of providing day-to-day care for the child or who has”
.

Clause 5(36) of the Schedule of the principal order is amended by revoking paragraph (b), and substituting the following paragraph:
(b)
any person authorised in writing by a parent or guardian (other than a person required by law not to have access to or contact with the child concerned, or access to the premises); and

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order, which comes into force on 1 July 2005, amends the Education (Home-Based Care) Order 1992. The amendments align the order with the Care of Children Act 2004—

by adding, to the references to
“custody of”
a child, references to“the role of providing day-to-day care for”
the child; and -

by adding, to references to
“access to”
a child, references to“contact with”
the child.
