These regulations are made under section 297 of the Fisheries Act 1996 on the advice and with the consent of the Executive Council.

Regulations
1 Title
These regulations are the Fisheries (South-East Area Commercial Fishing) Amendment Regulations 2025.
2 Commencement
These regulations come into force on 10 April 2025.
3 Principal regulations
These regulations amend the Fisheries (South-East Area Commercial Fishing) Regulations 1986.
4 Regulation 9 amended (Tailing at sea permitted in specified area)
In regulation 9, delete “the Fisheries Act 1983 or”

5 New regulation 11S inserted (Use of spears prohibited in defined areas)
After regulation 11R, insert:
11S Use of spears prohibited in defined areas
Commercial fishers must not use spears to take fish, and must not possess fish that have been speared, within the following waters:
(a)
Kaikōura Marine Area (Clarence Point to Conway River)—the waters defined as Te Whata Kai o Rakihouia i Te Tai o Marokura—Kaikōura Marine Area in Schedule 17 of the Fisheries (Amateur Fishing) Regulations 2013:
(b)
Motunau Island—the waters within the area enclosed by a line that encircles Motunau Island at a consistent distance of 0.5 nautical miles from the mean high-water mark of Motunau Island:
(c)
Banks Peninsula (Sumner Head to Lake Forsyth / Wairewa including Lyttelton Harbour)—the waters within the area enclosed by a line that—
(i)
commences at Sumner Head (at 43°34.151′S and 172°46.534′E); and
(ii)
then proceeds in a straight line in a northerly direction to a point at 43°33.141′S and 172°46.537′E; and
(iii)
then proceeds in a generally southerly direction along a line 1 nautical mile from the mean high-water mark to a point at 43°50.655′S and 172°42.594′E; and
(iv)
then proceeds in a straight line in a northerly direction to a point near Te Roto o Wairewa (entrance to Lake Forsyth) at 43°49.655′S and 172°42.599′E; and
(v)
then proceeds along the mean high-water mark to the commencement point at Sumner Head (at 43°34.151′S and 172°46.534′E):
(d)
Shag Point/Matakaea—the waters within the area enclosed by a line that—
(i)
commences at a point south of the Waihemo / Shag River mouth at 45°28.876′S and 170°49.025′E; and
(ii)
then proceeds in a straight line in a south-easterly direction to a point at 45°29.030′S and 170°49.343′E; and
(iii)
then proceeds in a generally northerly direction along a line 500 metres from the mean high-water mark to a point at 45°26.477′S and 170°49.098′E; and
(iv)
then proceeds in a straight line in a westerly direction to a point on the coast approximately 4 kilometres north of Shag Point/Matakaea at 45°26.480′S and 170°48.715′E; and
(v)
then proceeds in a generally southerly direction along the mean high-water mark to a point on the north of the Waihemo / Shag River mouth at 45°28.775′S and 170°49.149′E; and
(vi)
then proceeds in a straight line in a south-westerly direction to the commencement point on the south of the Waihemo / Shag River mouth (at 45°28.876′S and 170°49.025′E):
(e)
East Otago taiapure (Cornish Head to Potato Point)—the waters within the area described as East Otago taiapure in the Schedule of the Fisheries (East Otago Taiapure) Order 1999:
(f)
Otago Peninsula to Taieri Island (Heyward Point to Taieri Island/Moturata including Otago Harbour)—the waters within the area enclosed by a line that—
(i)
commences at Heyward Point (at 45°45.357′S and 170°41.512′E); and
(ii)
then proceeds in a straight line in a northerly direction to a point at 45°44.320′S and 170°41.564′E; and
(iii)
then proceeds in a generally south-westerly direction along a line 1 nautical mile from the mean high-water mark (including islands) to a point at 46°04.506′S and 170°13.531′E; and
(iv)
then proceeds in a straight line in a westerly direction to a point on the coast approximately 2 kilometres south of the Taieri River mouth at 46°04.465′S and 170°12.025′E; and
(v)
then proceeds in a generally northerly direction along the mean high-water mark to a point on the south bank of the Taieri River mouth at 46°03.351′S and 170°11.920′E; and
(vi)
then proceeds in a straight line to a point on the north bank of the Taieri River mouth at 46°03.080′S and 170°11.920′E; and
(vii)
then proceeds in a generally north-easterly direction along the mean high-water mark to the commencement point at Heyward Point (at 45°45.357′S and 170°41.512′E).
6 Regulation 12 amended (Offences)
In regulation 12(1),—
(a)
after “7(1)(d),”

Explanatory note
This note is not part of the regulations but is intended to indicate their general effect.
These regulations, which come into force on 10 April 2025, amend the Fisheries (South-East Area Commercial Fishing) Regulations 1986 (the principal regulations).
Regulation 4 amends regulation 9 of the principal regulations by deleting the reference to the Fisheries Act 1983 (which is now repealed).
Regulation 5 inserts new regulation 11S into the principal regulations. New regulation 11S prohibits the use of spears by commercial fishers within defined areas.
Regulation 12 of the principal regulations sets out offences for contravening or failing to comply with specified regulations. Regulation 6 amends regulation 12(1) to include offences for—
selling or possessing rock lobster or rock lobster tail that is not tagged or labelled in accordance with specified requirements; and
contravening or failing to comply with new regulation 11S.
