Pursuant to section 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

Regulations
1 Title
These regulations are the Fisheries (South-East Area Commercial Fishing) Amendment Regulations 2012.
2 Commencement
These regulations come into force on 1 May 2012.
3 Principal regulations
These regulations amend the Fisheries (South-East Area Commercial Fishing) Regulations 1986 (the principal regulations).
4 Regulation 3E amended (Set net soak times)

(1) In regulation 3E(1), delete
“and to subclauses (4) and (5)”
.(2) Replace regulation 3E(3) with:

“(3) The waters referred to in subclause (2) (known as Banks) are those waters enclosed by a line—
“(a) commencing at a point 4 nautical miles from the mean high-water mark of the South Island at 42°48.78′S and 173°27.36′E; then
“(b) proceeding in a generally east-south-easterly direction to a point at 42°54.40′S and 173°42.50′E; then
“(c) proceeding in a generally south-south-easterly direction to a point at 43°58.20′S and 173°57.90′E; then
“(d) proceeding in a generally west-south-westerly direction to a point at 44°37.20′S and 172°41.00′E; then
“(e) proceeding in a generally north-north-westerly direction to a point 4 nautical miles from the mean high-water mark of the South Island at 43°57.54′S and 172°15.41′E; then
“(f) proceeding generally in a north-easterly direction at a distance of 4 nautical miles from the mean high-water mark to the commencement point.”
(3) Revoke regulation 3E(4) and (5).

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on 1 May 2012, amend regulation 3E of the Fisheries (South-East Area Commercial Fishing) Regulations 1986, which relates to set net soak times. The amendments—
replace regulation 3E(3) to resolve ambiguities in the description of the waters (known as Banks) specified in that provision; and
revoke regulation 3E(4) and (5) because they are redundant provisions.
