Present:
His Excellency the Governor-General in Council
Pursuant to section 105 of the Medicines Act 1981, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council and on the advice of the Minister of Health given after consultation with the organisations or bodies that appear to be representative of persons likely to be substantially affected by the regulations, makes the following regulations.
Regulations
1 Title
These regulations are the Medicines Amendment Regulations 2012.
2 Commencement
These regulations come into force on the 28th day after the date of their notification in the Gazette.
3 Principal regulations
These regulations amend the Medicines Regulations 1984 (the principal regulations).
4 Regulation 2 amended (Interpretation)

(1) In regulation 2(1), definition of approved immunisation programme, paragraph (a), replace
“of the Ministry of Health”
with“administered by Pharmac”
.(2) In regulation 2(1), insert in its appropriate alphabetical order:
“Pharmac means the Pharmaceutical Management Agency established by section 46 of the New Zealand Public Health and Disability Act 2000”.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend regulation 2(1) of the Medicines Regulations 1984 (which contains definitions) to—
replace the reference to the Ministry of Health in the definition of approved immunisation schedule with a reference to Pharmac because of the transfer of responsibility for the National Immunisation Schedule from the Ministry to Pharmac; and
insert a definition of Pharmac.

Date of notification in Gazette: 1 November 2012.
These regulations are administered by the Ministry of Health.
