Note
These regulations are administered in the Ministry of Fisheries.
Pursuant to sections 89 and 91 of the Fisheries Act 1983 and sections 297 and 301 of the Fisheries Act 1996, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations.

1 Title
-
(1) These regulations are the Freshwater Fish Farming Amendment Regulations 2001.
(2) In these regulations, the Freshwater Fish Farming Regulations 19831 are called
“the principal regulations”
.
2 Commencement
These regulations come into force on the 28th day after the date of their notification in the Gazette.
3 Interpretation
Regulation 2 of the principal regulations is amended by revoking the definition of authorised officer, and substituting the following definition:
“authorised officer means a person or officer—
“(a) with the appropriate specialist qualifications; and
“(b) appointed in writing by the chief executive”.
4 Records to be maintained
Regulation 25(2) of the principal regulations is amended by inserting, before the word
“officer”
in the first place where it occurs, the word“authorised”
.
5 Preventive or remedial action
Regulation 27(1)(b) of the principal regulations is amended by inserting, before the word
“officer”
, the word“authorised”
.
6 Obstructing officer
Regulation 34 of the principal regulations is amended by omitting the word
“Officer”
, and substituting the words“officer or authorised officer”
.

Explanatory note
This note is not part of the regulations, but is intended to indicate their general effect.
These regulations, which come into force on the 28th day after the date of their notification in the Gazette, amend the Freshwater Fish Farming Regulations 1983
The amendments allow for people other than officers to enforce certain regulations, provided they have appropriate specialist qualifications and are appointed in writing by the chief executive.
