Pursuant to the Royal Warrant (SR 2008/23) dated 20 February 2008 instituting and creating the New Zealand Customs Service Medal, His Excellency the Governor-General of New Zealand, under authority delegated by The Queen, makes the following regulations.

Regulations

1 Title

These regulations are the New Zealand Customs Service Medal Regulations 2008.

2 Commencement

These regulations come into force on the day after the date of their notification in the Gazette.

3 Interpretation

Terms that are used in these regulations and defined in the Customs and Excise Act 2018 have the meanings given to them by that Act.

Regulation 3: amended, on 1 October 2018, by section 443(4) of the Customs and Excise Act 2018 (2018 No 4).

4 New Zealand Customs Service Medal

The New Zealand Customs Service Medal instituted and created by Royal Warrant dated 20 February 2008, and any clasps to the medal, may be awarded by the Minister of Customs, or by another Minister acting for that Minister, in accordance with these regulations and on the advice of the Comptroller of Customs.

5 Qualification for medal

(1)

The New Zealand Customs Service Medal may be awarded to an eligible person whose performance as a Customs officer, contribution to the Customs Service, and overall conduct are, in the opinion of the Comptroller of Customs, of sufficient standard to merit the award of the medal.

(2)

A person is eligible to be considered for the award of the New Zealand Customs Service Medal if the person—

(a)

is a permanent full-time or part-time Customs officer who is employed by the Customs Service on or after 1 December 2007; and

(b)

has served as a Customs officer for a minimum of 14 years, whether continuously or in aggregate, and whether the service is given before or after 1 December 2007.

6 Qualification for clasp

(1)

The clasp to the New Zealand Customs Service Medal may be awarded to an eligible person whose performance as a Customs officer, contribution to the Customs Service, and overall conduct are, in the opinion of the Comptroller of Customs, of sufficient standard to merit the award of a clasp to the medal.

(2)

A person is eligible to be considered for the award of a clasp to the New Zealand Customs Service Medal if the person has been awarded the medal and is a permanent full-time or part-time Customs officer who has served as Customs officer for a minimum of 7 years, whether continuously or in aggregate, since the award of the medal or any clasp.

7 Recognition of service with other organisations

(1)

The Comptroller of Customs may credit a person with up to 7 years towards eligibility for the New Zealand Customs Service Medal if—

(a)

the person has worked for an organisation other than the Customs Service; and

(b)

the person’s work in that organisation was, in the opinion of the Comptroller of Customs, similar in nature to the work of a Customs officer; and

(c)

the Comptroller of Customs is satisfied that the person’s conduct and performance while engaged in that work was of a high standard.

(2)

The Comptroller of Customs must not credit time towards eligibility under subclause (1) if the person has already received a service medal for the work with the other organisation.

8 Special awards

(1)

A special award of the New Zealand Customs Service Medal or clasp may be made to a Customs officer in either of the following circumstances:

(a)

the Customs officer has lost his or her life, or has sustained serious injuries, in the performance of his or her duties as a Customs officer; and—

(i)

in the opinion of the Comptroller of Customs, the person’s contribution to the Customs Service and overall conduct were of a sufficient standard to merit the award of the medal or clasp; but

(ii)

the person has not completed the required period of service to qualify for the medal or clasp:

(b)

the Customs officer is eligible in all respects for the award of the medal or clasp, but dies before it is awarded.

(2)

In subclause (1)(a), sustained serious injuries means having sustained injuries, or suffered a disability, of a nature or severity that renders the person no longer able to serve as a Customs officer.

(3)

A special award may be made under subclause (1)(a) only to a person who is or was employed by the Customs Service on or after 1 December 2007.

9 Forfeiture and restoration of award

The Minister may, on the advice of the Comptroller of Customs,—

(a)

order the forfeiture of an award of the medal and any clasps made to a person; in which case the Comptroller of Customs must remove the person’s name from the register maintained under the Royal Warrant; and

(b)

order the restoration of an award of the medal and any clasps to a person whose award was forfeited; in which case the Comptroller of Customs must reinstate the person’s name on the register.
