(1)
A person commits an offence in respect of an application for approval of a psychoactive product if the person—
provides information that the person knows, or ought to know, is materially false or misleading; or
fails, without reasonable excuse, to provide any relevant information relating to—
the ingredients of the product; or
the effect of the product on individuals who use the product.
(2)
A person who commits an offence against subsection (1) is liable on conviction to a term of imprisonment not exceeding 3 months or a fine not exceeding $500,000, or both.
