39 Refusal to grant approval


If the Authority proposes to refuse to approve a psychoactive product as an approved product, the Authority must give the applicant—


written notice that clearly informs the applicant of the grounds for the proposed refusal; and


a reasonable opportunity to make written submissions.


If, after considering any submissions provided by the applicant under subsection (1)(b), the Authority decides to refuse to approve the product, the Authority must, as soon as practicable, give the applicant written notice of—


the decision and the reasons for it; and


the applicant’s right to appeal against the decision under section 45.
