Pursuant to section 2 of the Criminal Disclosure Act 2008, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

This order is the Criminal Disclosure Act Commencement Order 2009.
2 Commencement of Criminal Disclosure Act 2008
The Criminal Disclosure Act 2008 comes into force on 29 June 2009.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order brings into force, on 29 June 2009, the Criminal Disclosure Act 2008 (the Act). The purpose of the Act is to promote fair, effective, and efficient disclosure of relevant information between the prosecution and the defence, and by non-parties, for the purposes of criminal proceedings. The codification of criminal disclosure requirements in the Act is a companion measure to the new committal procedure implemented by the Summary Proceedings Amendment Act (No 2) 2008.
