Maniapoto Maori Trust Board Order 2002: revoked, on 23 May 2008, by section 8(b) of the Maniapoto Maori Trust Board Amendment Act 2008 (2008 No 32).

Pursuant to sections 55A and 56 of the Maori Trust Boards Act 1955, Her Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

1 Title
This order is the Maniapoto Maori Trust Board Order 2002.
2 Commencement
This order comes into force on the day after the date of its notification in the Gazette.
3 Interpretation
In this order,—
Act means the Maori Trust Boards Act 1955
Committee means a Regional Management Committee as defined in section 2 of the Maniapoto Act
Maniapoto Act means the Maniapoto Maori Trust Board Act 1988 (1988 No 229)
Trust Board means the Maniapoto Maori Trust Board.
4 Background
-
(1) The Trust Board is constituted by the Maniapoto Act and is a Maori Trust Board under the Act.
(2) Section 6 of the Maniapoto Act provides that the Trust Board must include the following members, elected in accordance with regulations made under section 56 of the Act:
(a) 6 members elected by beneficiaries:
(b) 6 members elected by Committees.
(3) Section 8 of the Maniapoto Act provides that there must be the number of Committees as is specified in regulations made under section 56 of the Act to represent the marae specified in those regulations.
(4) Committees have been established to represent marae in the Maniapoto area and have elected members of the Trust Board even though the regulations required by section 8 of the Maniapoto Act have not been made.
(5) The Trust Board held an election for membership of the Trust Board in October 2001.
(6) However, that election was irregular (and is declared invalid by clause 8) because votes were cast for a candidate whose nomination had been withdrawn.
5 Regional Management Committees

(1) There are 6 Committees.
(2) Each Committee must elect 1 member of the Trust Board.
(3) Each Committee must determine the process and method for electing a member of the Trust Board.
6 Commencement of term of members
Following an election to membership of the Trust Board, the term of appointment of a member elected by a Committee must commence on the same day as the term of appointment of a member elected by beneficiaries.
7 Election of members
Beneficiaries of the Trust Board must elect 6 members of the Trust Board.
8 Election declared invalid
The election of members of the Trust Board held in October 2001 is invalid because of the irregularity summarised in clause 4(6).
9 Fresh election required

(1) The Trust Board must hold an election of members of the Trust Board as soon as practicable after this order comes into force.
10 Timing of fresh election
-
(1) The Secretary of the Trust Board must give the public notice required by section 46 of the Act by 20 November 2002.
(2) Nominations for election to membership must be lodged with the Secretary of the Trust Board by 20 December 2002.
(3) If an election is required by section 48 of the Act, the Secretary of the Trust Board must post the following documents to beneficiaries entitled to vote by 31 January 2003:
(a) a printed ballot paper required by section 51 of the Act; and
(b) the form of declaration required by regulation 10 of the Maori Trust Boards Regulations 1985.
(4) Ballot papers must be posted to, or lodged with, the Returning Officer, under section 52 of the Act, by 28 February 2003.
(5) The Secretary of the Trust Board must comply with section 49(1) of the Act (and forward the names of persons elected as members of the Trust Board to the chief executive of Te Puni Kokiri) by 31 March 2003.
11 Maori Trust Boards Regulations 1985 amended
The Second Schedule of the Maori Trust Boards Regulations 1985 (SR 1985/258) is amended by inserting, after the item relating to the Hauraki Maori Trust Board, the following item:
Maniapoto Maori Trust Board 1 Rereahu Regional Management Committee, comprising the following marae: Te Miringa Te Kakara Mangapeehi Te Hape Te Ihingarangi 1 Mokau Ki Runga Regional Management Committee, comprising the following marae: Maniaroa Mokau Kohunui Napinapi Paemate Te Kawau Papakainga 1 Tuhua/Hikurangi Regional Management Committee, comprising the following marae: Nga Hapu (Ohura) Kaitupeka Te Koura Manu Ariki Te Rongoroa Waipu Tuwhenua 1 Hauaru Ki Uta Regional Management Committee, comprising the following marae: Rakaunui Marokopa Pohatuiri Tokikapu Kapatuhi Te Kauae Te Korapatu Rere a Manu 1 Nehenehenui Regional Management Committee, comprising the following marae: Purekireki Te Kopua Mangatoatoa Kahotea Te Keeti Tarewaanga Turitea Te Kohitanga Ko Te Hokingamai ki te Nehenehenui Te Whakaaro Kotahi Hiona 1 Te Tokanganui a Noho Regional Management Committee, comprising the following marae: Te Kumi Oparure Te Tokanganui a noho Motiti Parekaitini Mangarama Te Ahoroa Te Piruru Tane Hopuwai

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order, which comes into force on the day after the date of its notification in the Gazette, invalidates the election, in October 2001, of members of the Maniapoto Maori Trust Board because of an irregularity in that election. The order caters for a fresh election.
The Maori Trust Boards Regulations 1985 are amended—
•to establish 6 Regional Management Committees to represent divisions (marae) of beneficiaries of the Trust Board:
•to provide for the election of 1 member of the Trust Board by each Regional Management Committee:
•to provide for the election of 6 members of the Trust Board by beneficiaries.
