Pursuant to section 114(5) of the Limited Partnerships Act 2008, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.
Order
1 Title
This order is the Limited Partnerships Act Amendment Order 2008.
2 Commencement
This order comes into force on 24 July 2008.
3 Liquidation of overseas limited partnership
Section 114(1) of the Limited Partnerships Act 2008 is amended by omitting
“the assets in New Zealand of”
.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order comes into force on 24 July 2008, the same date on which the Insolvency (Cross-border) Act 2006 comes into force. That Act amends the terminology used in the Companies Act 1993 to refer to the liquidation of an overseas company. In anticipation of that change, Section 114(1) of the Limited Partnerships Act 2008 made provision for a corresponding amendment, to be made by Order in Council, to the Limited Partnerships Act 2008 in relation to an overseas limited partnership. This order now makes that amendment.
