Pursuant to section 13 of the Commodity Levies Act 1990 (as applied by section 305 of the Fisheries Act 1996), His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.

1 Title

This order is the Commodity Levies (Nelson–Marlborough Dredge Oysters) Amendment Order 2006.

2 Commencement

This order comes into force on 9 September 2006.

3 Principal order amended

This order amends the Commodity Levies (Nelson–Marlborough Dredge Oysters) Order 2001.

4 New clause 2A inserted

The following clause is inserted after clause 2:
“2A Extension and expiry

This order is extended until the close of 9 September 2012 and then expires.”

5 Interpretation

The definition of company in clause 3 is amended by omitting “, on the commencement of this order, as the Challenger Dredge Oyster Fishery Management Company Limited” and substituting “, on the commencement of the Commodity Levies (Nelson–Marlborough Dredge Oysters) Amendment Order 2006, as the Challenger Oyster Management Company Limited”.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 9 September 2006—

extends the Commodity Levies (Nelson–Marlborough Dredge Oysters) Order 2001 until the close of 9 September 2012; and
amends the definition of company to take account of a change of the company's name (on 13 March 2003) from the Challenger Dredge Oyster Fishery Management Company Limited to the Challenger Oyster Management Company Limited.
