The Parliament of New Zealand enacts as follows:

1 Title

  • (1) This Act is the Defence Amendment Act 2005.

    (2) In this Act, the Defence Act 1990 is called “the principal Act”.

2 Commencement

  • This Act comes into force on the day after the date on which it receives the Royal assent.

3 Chief of Defence Force

  • Section 8(3) of the principal Act is amended by repealing paragraph (a), and substituting the following paragraph:

    • “(a) command the Navy through the Chief of Navy, the Army through the Chief of Army, and the Air Force through the Chief of Air Force: and”.

4 Chiefs of Staff

  • (1) Section 28(1) of the principal Act is amended by omitting the words “Chief of Naval Staff”, and substituting the words “Chief of Navy”.

    (2) Section 28(2) of the principal Act is amended by omitting the words “Chief of General Staff”, and substituting the words “Chief of Army”.

    (3) Section 28(3) of the principal Act is amended by omitting the words “Chief of Air Staff”, and substituting the words “Chief of Air Force”.

    (4) Section 28(5) of the principal Act is amended by omitting the words “Chief of Naval Staff or Chief of General Staff or Chief of Air Staff”, and substituting the words “Chief of Navy or Chief of Army or Chief of Air Force”.

5 Chiefs of Staff Committee

  • Section 29(1) of the principal Act is amended by repealing paragraphs (b) to (d), and substituting the following paragraphs:

    • “(b) the Chief of Navy:

    • “(c) the Chief of Army:

    • “(d) the Chief of Air Force.”.

6 Conditions of service in Armed Forces

  • Section 45(4) of the principal Act is amended by repealing paragraphs (b) to (d), and substituting the following paragraphs:

    • “(b) the Chief of Navy; or

    • “(c) the Chief of Army; or

    • “(d) the Chief of Air Force,—”.

7 Unit and other non-public funds

  • (1) Section 58(1) of the principal Act is amended by—

    • (a) omitting from paragraph (b) the words “Chief of Naval Staff”, and substituting the words “Chief of Navy” ; and

    • (b) omitting from paragraph (c) the words “Chief of General Staff”, and substituting the words “Chief of Army” ; and

    • (c) omitting from paragraph (d) the words “Chief of Air Staff”, and substituting the words “Chief of Air Force”.

    (2) Section 58(3) of the principal Act is amended by omitting the words “Chief of Naval Staff”, and substituting the words “Chief of Navy”.

    (3) Section 58(4) of the principal Act is amended by omitting the words “Chief of General Staff”, and substituting the words “Chief of Army”.

    (4) Section 58(5) of the principal Act is amended by omitting the words “Chief of Air Staff”, and substituting the words “Chief of Air Force”.

8 Consequential amendment to Remuneration Authority Act 1977

  • Schedule 4 of the Remuneration Authority Act 1977 is amended by omitting the items relating to the Chief of Naval Staff, the Chief of General Staff, and the Chief of Air Staff, and substituting the following items:

    “The Chief of Navy The Chief of Army

    “The Chief of Air Force.”
