PURSUANT to the Tokelau Islands Act 1948, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following regulations.

Schedule
Regulations and ordinances ceasing to form part of the law of the Tokelau Islands

1 Title and commencement

(1) These regulations may be cited as the Tokelau Islands (New Zealand Laws) Regulations 1975.

(2) These regulations shall come into force on the date of the commencement of Part 1 of the Tokelau Islands Amendment Act 1970.

2 Arbitration Act in force in Tokelau Islands

(1) The Arbitration Act 1908 shall be in force in the Tokelau Islands.

(2) In the application of that Act to the Tokelau Islands, every reference in that Act to New Zealand shall be read as a reference to the Tokelau Islands . . ..

Regulation 2(2) was amended, as from 1 August 1986, by section 14 Tokelau Amendment Act 1986 (1986 No 31) by omitting the words “, and every reference to the Supreme Court shall be read as a reference to the High Court of Niue”.

3 Chattels Transfer Act in force in Tokelau

(1) The Chattels Transfer Act 1924 shall be in force in Tokelau.

(2) In the application of that Act to Tokelau, every reference to a Justice of the Peace shall be read as a reference to a Judge of the High Court of New Zealand and to the Commissioner for Atafu or for Fakaofo or for Nukunonu.

Regulation 3 was substituted, as from 1 August 1986, by section 15 Tokelau Amendment Act 1986 (1986 No 31).

4 Marine Insurance Act in force in Tokelau Islands

The Marine Insurance Act 1908 shall be in force in the Tokelau Islands.

Regulation 5 was revoked, as from 31 May 1990, by regulation 5 Tokelau Marine Pollution Regulations 1990 (SR 1990/91).

6 Trustee Act in force in Tokelau

(1) The Trustee Act 1956 shall be in force in Tokelau, subject to the modification set out in subclause (2) of this regulation.

(2) Every reference in that Act to New Zealand shall be read as a reference to Tokelau.

Regulation 6 was substituted, as from 1 August 1986, by section 16 Tokelau Amendment Act 1986 (1986 No 31).

7 Section 5 of Western Samoa Act in force in Tokelau Islands

Section 5 of the Western Samoa Act 1961 shall be in force in the Tokelau Islands as if the reference in that section to New Zealand were a reference to the Tokelau Islands.

8 Certain enactments not to apply to Tokelau Islands

(1) The regulations and Ordinances of the Gilbert and Ellice Islands Colony specified in the Schedule to these regulations shall, after the commencement of these regulations, cease to have effect as part of the law of the Tokelau Islands.

(2) The provisions of sections 20, 20A, and 21 of the Acts Interpretation Act 1924 shall apply with respect to the enactments specified in the Schedule to these regulations as if they were Acts of the Parliament of New Zealand that had been repealed by subclause (1) of this regulation.

Explanatory note

This note is not part of the regulations, but is intended to indicate their general effect.

These regulations declare that the New Zealand Acts specified shall be in force in the Tokelau Islands, with such modifications as are stated in the regulations.

They also declare that certain regulations and Ordinances of the Gilbert and Ellice Islands Colony shall cease to be in force in the Tokelau Islands.
