Pursuant to section 2(2) and (4) of the Search and Surveillance Act 2012, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following order.
Order
1 Title
This order is the Search and Surveillance Act Commencement Order 2012.
2 Interpretation
In this order, Act means the Search and Surveillance Act 2012.
3 Commencement of certain provisions of Act on 1 October 2012
The following provisions of the Act come into force on 1 October 2012:
(a) Part 2; and
(b) Section 49(3) and (4) and subparts 2 to 4 of Part 3; and
(c) Part 4, except sections 136, 140, 141, 148, 162, 165 to 172, 175, and 179 to 181; and
(d) Part 5, except sections 201(3) to (9), 247, 248, 251(3), 302, 325(1) to (3), (5), and (7) to (13), 334(1) and (7), 337(4), 342, 343, 346, 347, 349, 350, and 352 to 356; and
-
(e) the Schedule, except the items relating to—
(ii) the Tax Administration Act 1994.
4 Commencement of certain provisions of Act on 30 June 2013
The following provisions of the Act come into force on 30 June 2013:
(a) section 201(3) to (9); and
(b) the item in the Schedule relating to the Anti-Money Laundering and Countering Financing of Terrorism Act 2009.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order brings certain provisions of the Search and Surveillance Act 2012 (the Act) into force. The Act makes provision about the powers of the Police and other enforcement officers in relation to search, seizure, and surveillance. The bulk of the provisions are commenced on 1 October 2012, with amendments to the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 (and related items in the Schedule) coming into force on 30 June 2013.
Section 302 of the Act, which amends the Tax Administration Act 1994, and the item in the Schedule relating to that Act, remain to be brought into force.
