This order is administered in the Ministry of Commerce.
PURSUANT to section 1(4) of the Energy Companies Act 1992, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
1 Title
This order may be cited as the Energy Companies Act Commencement Order 1994.
2 Commencement of sections 89 and 96 of the Energy Companies Act 1992
Sections 89 and 96 of the Energy Companies Act 1992 shall come into force on the 7th day of October 1994.

Explanatory note
This note is not part of the order, but is intended to indicate its general effect.
This order brings into force, on 7 October 1994, sections 89 and 96 of the Energy Companies Act 1992.
Section 89—
(a) Inserts a new section 334A into the Local Government Act 1974 relating to the powers of councils to light roads; and
(b) Repeals Part 30 of the Local Government Act 1974, which deals with the supply of energy by local authorities.
On 1 September 1994 every local authority the operations of which included an energy undertaking had transferred that energy undertaking to an energy company. Part 30 of the Local Government Act 1974 was therefore no longer required as from that date.
Section 96 repeals the Electric Power Boards Act 1925 and makes certain consequential amendments. From 1 September 1994 that Act was no longer necessary because an Order in Council made under section 47(1) of the Energy Companies Act 1992 had come into force in respect of each electric power board.
