An Act—

  • (a) To amend the Aviation Crimes Act 1972 to give effect to the provisions of the Montreal Protocol for the Suppression of Unlawful Acts of Violence at Airports Serving International Civil Aviation; and

  • (b) To give effect to further matters incidental to the Hague Convention for the Suppression of Unlawful Seizure of Aircraft and the Montreal Convention for the Suppression of Unlawful Acts Against the Safety of Civil Aviation

BE IT ENACTED by the Parliament of New Zealand as follows:

1 Short Title and commencement

  • (1) This Act may be cited as the Aviation Crimes Amendment Act 1999, and is part of the Aviation Crimes Act 1972 (“the principal Act”).

    (2) This Act comes into force on 1 September 1999.

2 Altering Title of principal Act

  • The Title of the principal Act is amended by inserting, after the words “Civil Aviation,”, the words “the Montreal Protocol for the Suppression of Unlawful Acts of Violence at Airports Serving International Civil Aviation,”.

3 Interpretation

  • This section inserted in section 2(1) of the principal Act the definitions Act of violence, International airport, and The Montreal Protocol.

4 Heading amended

  • The heading above section 3 was amended by adding the words “and International Airports”.

5 Other crimes relating to aircraft

  • This section amended section 5(a) of the principal Act.

6 Crimes relating to international airports

  • This section amended section 5A of the principal Act.

7 Section 6 of principal Act repealed

  • Section 6 of the principal Act is repealed.

8 Crimes against section 5A deemed to be included in extradition treaties

  • This section amended section 7A of the principal Act.

9 Application of sections 3, 4, and 5

  • (1) This subsection inserted section 9(1)(d) of the principal Act.

    (2) This subsection inserted section 9(2)(d) of the principal Act.

10 Application of section 5A

  • This section amended section 9A of the principal Act.

11 Attorney-General's consent required to prosecutions

  • This section amended section 18 of the principal Act.

12 Other Acts not affected

  • This section amended section 21 of the principal Act.
