Order

1 Title

This order is the Community Trusts (Boundary Adjustment) Order 2018.

2 Commencement

This order comes into force on 19 July 2018 (the commencement date).

3 Interpretation

In this order,—

TSB Community Trust means the community trust called by that name immediately before the commencement date that was established as the Taranaki Savings Bank Community Trust by a trust deed dated 30 May 1988

Whanganui Community Foundation Incorporated means the community trust called by that name immediately before the commencement date—

(a)

that was established as the Wanganui Trust Bank Community Trust by a trust deed dated 30 May 1988; and

(b)

whose trustees were incorporated as a charitable trust board under the Charitable Trusts Act 1957 on 5 August 1988.

4 Approval of scheme to adjust adjoining boundaries of TSB Community Trust and Whanganui Community Foundation Incorporated

The scheme to adjust the adjoining boundaries of the TSB Community Trust and Whanganui Community Foundation Incorporated is approved for the purposes of section 16A of the Community Trusts Act 1999 so that the areas of the community trusts are adjusted to the areas described in the Schedule.

5 Date of boundary adjustment and asset transfer under scheme

The date for the purposes of section 16A(6) of the Community Trusts Act 1999 is the commencement date.

Part 1 Description of area of TSB Community Trust

All that area comprising the counties of Clifton, Egmont, Eltham, Hawera, Inglewood, Stratford, Taranaki, Waimate West, and Patea (as the said counties were constituted on the 1st day of October 1964) such that the southern boundary of the area coincides with the southern boundary of the South Taranaki District Council area as designated in the Local Government (Taranaki Region) Reorganisation Order 1989 (Gazette 1989, p 2445), and including all cities, boroughs, and town districts surrounded by or contiguous to that defined area.

Part 2 Description of area of Whanganui Community Foundation Incorporated

All that part of the Ruapehu District comprising the former Waimarino County, together with the districts of Wanganui and Rangitīkei as established in 1989.

Explanatory note

This note is not part of the order, but is intended to indicate its general effect.

This order, which comes into force on 19 July 2018 (the commencement date), approves an adjustment to the adjoining boundaries of the areas of TSB Community Trust and Whanganui Community Foundation Incorporated proposed by the 2 community trusts in a scheme submitted to the Minister of Finance under section 16A of the Community Trusts Act 1999 (the Act).

The areas of the 2 community trusts are adjusted to align with the areas described in the Schedule of this order and the proposed changes to the trust deeds submitted to the Minister of Finance under section 16A(2)(e) of the Act.

The $350,000 proposed to be transferred under the scheme vests in the trustees of the TSB Community Trust on the commencement date in the manner proposed by the trustees of the community trusts in accordance with section 16A(2)(f) of the Act and is to be held by the TSB Community Trust on, and subject to, the trust contained in the TSB Community Trust trust deed.
