(1)
An employer may adopt a policy that allows the employer to not consider a request under section 28A for a portion of an employee’s annual holidays to be paid out.
(2)
A policy under subsection (1) may apply to—
the whole of the employer’s business; or
some parts of the employer’s business but not to others.
(3)
If an employer has a policy under subsection (1), section 28A does not apply in relation to any part of the employer’s business to which the policy applies.
