28C Requirement to request payout prohibited

(1)

A requirement that an employee must make a request under section 28A for a portion of his or her annual holidays entitlement to be paid out must not be a term or condition of the employee’s employment (whether contained in an employment agreement or otherwise).

(2)

Despite subsection (1), an employment agreement may set out the process for making a request under section 28A.
